Please read these Terms of Service (“Agreement,” “Terms of Service,” “Terms and Conditions”) carefully before accessing or using any HeartCore LLC website, service, or studio facility (“HeartCore,” “we,” “us,” or “our”). This Agreement forms a legally binding contract between you and HeartCore LLC.
By accessing or using www.theheartcoretx.com (“the Site”), visiting our physical studio locations, creating an account through Mariana Tek, purchasing classes or memberships, participating in HeartCore programming, or otherwise using HeartCore Services, you agree to be bound by these Terms.
If you do not agree to these Terms, you must immediately discontinue use of the Site, your HeartCore account, and all HeartCore Services.
I. DESCRIPTION OF SERVICES
HeartCore LLC provides boutique fitness and wellness services, including but not limited to:
- Lagree Megaformer classes
- Rhythm-based indoor cycling classes
- Body Roll Sessions
- Strength, sculpt, and specialty classes
- Private training
- Workshops, community events, and educational programming
- Website content, digital resources, and online booking
- Social media content and communications
- In-app services through Mariana Tek
- Retail sales (merchandise, accessories, grip socks, SPD shoe rentals, etc.)
These Terms apply to all HeartCore Services, whether accessed in-studio, online, through third-party platforms, or via mobile/desktop applications.
II. ACCEPTANCE OF TERMS
Your use of HeartCore Services indicates your unconditional acceptance of this Agreement. HeartCore may modify these Terms at any time. Updated Terms will be posted on the Site, and continued use of the Services constitutes acceptance of the modified Terms.
III. REGISTRATION INFORMATION
To use HeartCore Services, you must create an account through Mariana Tek, our scheduling, booking, and payment platform. By registering:
- You represent that you are 18+,
OR ages 15–18 with a parent/guardian signature on file. - You agree to provide accurate, complete, and current information.
- You agree to update your Account information whenever changes occur.
Failure to provide accurate information may result in suspension or termination of your account.
HeartCore does not permit anyone under age 15 to participate in classes.
IV. ACCOUNT SECURITY & PASSWORD PROTECTION
You are responsible for maintaining the confidentiality of your username and password. You may not share your login or allow others to use your account.
If HeartCore has reason to believe you shared your login, streamed classes to non-paying users, or misused your account, HeartCore may immediately terminate your account without refund.
V. THIRD-PARTY PLATFORM & PAYMENT STORAGE
HeartCore Services are hosted and integrated with third-party provider Mariana Tek, which is responsible for:
- Account creation
- Login credentials
- Payment processing
- Credit card storage
HeartCore LLC does not store, access, or retain your credit card information.
All sensitive payment data is securely stored and encrypted by Mariana Tek and its PCI-compliant payment processor.
For platform-related issues, users must contact Mariana Tek Support.
VI. STUDIO POLICIES & MEMBER RULES
1. CLASS RESERVATIONS
- You must have a valid class credit or membership to reserve.
- Booking is completed through Mariana Tek or the HeartCore app.
- First-timers must arrive 10 minutes early for orientation. Late entry is not permitted for first-time clients.
- Returning clients have a 5-minute grace period.
2. CANCELLATION & NO-SHOW POLICY
You must cancel by 7:00 PM CST the day prior to your scheduled class to avoid penalties.
Fees apply as follows:
- Late Cancel: $15
- No Show: $25
This applies to all membership types, class packs, free classes, specials, and drop-ins.
No cancellations via email, DM, or phone will be accepted.
3. WAITLIST POLICY
If you join a waitlist:
- You may be added to class automatically up to 15 minutes before start time.
- If added, the cancellation/no-show policy applies.
- If you can no longer attend, remove yourself from the waitlist.
4. MEMBERSHIP TERMS
HeartCore offers:
- Month-to-month membership (1 type only)
- All other memberships require a 3-month or 12-month commitment
Memberships auto-renew each billing cycle. Monthly credits do not roll over.
If a payment fails:
- Your booking privileges will be suspended until resolved.
- HeartCore may attempt to recharge the card on file.
5. FREEZE POLICY
- Freezes may be requested once every 6 months, for legitimate reasons such as medical leave or extended work travel.
- Freeze requests must be submitted at least 7 days before your next billing cycle.
- Memberships may not be canceled while frozen.
6. CLASS PACK EXPIRATIONS
- 5-Pack: Expires in 3 months
- 10-Pack: Expires in 6 months
- 20-Pack: Expires in 12 months
No extensions, transfers, or sharing.
7. STUDIO ETIQUETTE & RULES
To maintain the HeartCore experience:
- SPD clip-in shoes required for cycling (rentals available).
- Grip socks required for Lagree (available for purchase).
- No filming others without consent.
- Limited filming allowed only in designated areas (back row / back machine).
- No phone calls in the studio or during class.
- No saving of machines or bikes.
- Appropriate workout attire required.
- Check in at front desk before class.
HeartCore may refuse entry at any time for safety or behavior concerns.
8. PERSONAL BELONGINGS & LOST ITEMS
HeartCore is not responsible for lost, stolen, or damaged personal items.
You are responsible for securing your belongings.
9. NO COACH GUARANTEE
HeartCore does not guarantee that a specific coach will teach any class. Coaches may be substituted without notice.
VII. WAIVER OF LIABILITY & ASSUMPTION OF RISK
By participating in HeartCore Services, you acknowledge the inherent risks of physical activity, including but not limited to:
- Muscle strains
- Cardiovascular events
- Injuries caused by equipment
- Accidents due to physical exertion
- Exposure to illness, including COVID-19
You voluntarily assume all risk and agree:
- HeartCore LLC, its employees, contractors, instructors, owners, and partners are not liable for injuries, illness, property damage, or death arising from participation.
- Users with health conditions must consult a doctor before participating.
- Pregnant participants accept all pregnancy-related risks.
Minors (15–18) may only participate with a parent/guardian signature.
VIII. MEDIA RELEASE
By attending HeartCore classes or events, you grant HeartCore permission to use photos or videos of you for marketing or promotional purposes.
You waive rights to compensation or approval.
IX. INTELLECTUAL PROPERTY
All content, trademarks, logos, class formats, photographs, videos, and materials provided by HeartCore are owned by HeartCore LLC and protected under U.S. law.
You may not copy, distribute, sell, record, exploit, or reproduce any HeartCore content without written permission.
X. MOBILE SERVICES
HeartCore may send SMS, push notifications, and emails through Mariana Tek or directly. Carrier fees may apply.
XI. DISCLAIMER OF WARRANTIES — “AS IS”
HeartCore Services are provided “AS IS,” “WITH ALL FAULTS,” and WITHOUT WARRANTIES OF ANY KIND, expressed or implied.
HeartCore does not guarantee:
- uninterrupted service
- error-free or secure operation
- availability of classes, coaches, or equipment
Some states do not allow warranty exclusions; these limitations apply to the fullest extent permitted by law.
XII. LIMITATION OF LIABILITY
To the maximum extent permitted by Texas law:
HeartCore’s total liability to any user is capped at $50.
HeartCore is not liable for:
- Incidental or consequential damages
- Lost profits
- Interruptions or service issues
- Equipment malfunctions
- Misuse of any HeartCore product or service
XIII. INDEMNIFICATION
You agree to indemnify and hold harmless HeartCore LLC from any claims, damages, costs, attorney fees, or liabilities arising from your use of the Services or breach of this Agreement.
XIV. GOVERNING LAW & ARBITRATION (TEXAS)
These Terms are governed by the laws of the State of Texas.
Any dispute, claim, or controversy must be resolved exclusively through binding arbitration in Harris County, Texas, in accordance with the American Arbitration Association.
No class actions or consolidated claims are permitted.
Either party may seek injunctive relief for intellectual property matters.
XV. MUTUAL NON-DISPARAGEMENT
You agree not to publicly disparage HeartCore, its employees, services, or community.
Concerns must be addressed privately to HeartCore.
XVI. FORCE MAJEURE
HeartCore is not liable for delays or inability to provide services due to events outside its control (natural disasters, pandemics, government orders, etc.).
XVII. TERMINATION
HeartCore may terminate or suspend your account at any time for:
- Policy violations
- Fraudulent behavior
- Safety concerns
- Disruptive behavior
Unused classes or membership fees are non-refundable upon termination.
XVIII. CHANGES TO TERMS
HeartCore may update these Terms at any time. Updated versions will be posted to the Site.
